By “Client” is mentioned any person or company booking any type of services for their purpose or on behalf of an individual, group or company through Swiss Motivation Travel.

SMT places the utmost importance on protecting the data of their customers and their private sphere. We safeguard and treat all personal data as per the law regulation.  

Personal data includes all information relating to an identified or identifiable person.

Swiss Motivation Travel Data security and privacy

By “Personal Data” the following definitions apply:

  1. personal data (data): all information relating to an identified or identifiable person;
  2. data subjects: natural or legal persons whose data is processed;
  3. sensitive personal data: data on: a.religious, ideological, political or trade union-related views or activities; b.health, the intimate sphere or the racial origin; c.social security measures; d.administrative or criminal proceedings and sanctions;

 

  1. SMT shall only process any personal data provided under this agreement for the purpose of providing the applicable services subject to the written instructions from the client. With the goal of improving services and based on the data given to SMT, SMT may send additional information related to current or future event(s) and/or trip(s) to the client.
  1. SMT shall have implemented and shall maintain appropriate technical and organizational measures to protect such personal data against any accidental, unauthorized or unlawful use, destruction, loss, alteration, disclosure or access.
  1. SMT shall as quickly as possible (ideally within 72 hours) notify the client if it suspects or becomes aware of any suspected, actual or threatened occurrence of any personal data breach.
  1. SMT undertakes to comply with and to enforce the applicable legal and regulatory rules regarding confidentiality and personal data protection matters in the course of the implementation of the Agreement for the provision of tourist services, even after its performance.
  1. SMT treats personal data only by means of written requests or registration website, including issues relating to data transfers to third countries or international organizations, being specifically obliged to take measures in order to ensure that any natural person under his responsibility with access to personal data only proceeds to its treatment following the client instructions or client
  1. SMT makes every effort to guarantee that appropriate technical and organizational measures are implemented in order to ensure that the processing complies with the legal requirements, in particular, by ensuring a security level appropriate to the risk, as well as the defense of the data subjects rights, taking into account the most advanced techniques, the implementation costs and the nature, scope, context and purpose of the processing, as well as the probability and gravity risks for the rights and freedom of natural persons.
  1. SMT assures that the authorized persons to process the personal data will assume a confidentiality commitment or that they are subject to adequate legal obligations of confidentiality, even after the termination of the agreement.
  1. SMT will process its outmost to assist the client by means of appropriate technical and organizational measures in order to enable the latter to comply with its obligation or respond the requests of the data owners regarding the exercise of the rights.
  1. SMT undertakes to promptly make available to the client all information necessary to demonstrate the compliance with legal obligations and to facilitate and contribute to the audits including inspections, carried out by the client or by another auditor under its responsibility.
  1. In order to make bookings, SMT might need to transfer personal data to various third-party travel suppliers (such as, but not limited to airlines, hotels, car rental companies, guides, online booking tool companies, safety and security tracking providers and computer booking systems) within your home country or in another country where you may be traveling and often also to government bodies if needed. SMT uses third-party service providers to present services and offers tailored to the preferences and interests of the client.
  1. SMT undertakes to eliminate all personal data related to the processing, by eliminating the existing copies, except if the conservation of data is legally required or requested by the client for future events.
  1. SMT undertakes to comply with the obligations established in this agreement and the current regulations, in relation to this processing.
  1. By providing personal data of yourself, clients, colleagues or any individuals, the client hereby agrees and gives consent to SMT to transfer and communicate data to third parties in the objective of providing the most valuable level of services for the client.
  1. The client must ensure that the data provided to SMT must be correct, accurate, current truthful and compliant with any applicable laws.
  1. This document may be revised and updated by SMT from time to time to comply with statutory data protection and privacy laws. SMT will post any statement changes on its website mentioning the date of the last update.
  1. This Agreement shall be construed and governed by the laws of Switzerland. All disputes arising out of or in connection with this Agreement shall be submitted to the courts of Geneva Canton, Switzerland for final settlement.
